If the time has come when you’ve accepted your marriage is no longer solvent and that the best thing you can do is to just walk away from it, there will be several things you need to do to prepare yourself for the upcoming legal process.

First things first, you and your spouse need to gather up all your important documentation and make sure each of you has a copy of everything which you will than take to your divorce lawyer. You will need to have all of your financial information, property deeds, and any legal papers you’ve accumulated throughout the years. You shouldn’t try hiding anything, more often than not, things like extra savings account or hidden assets come to light. It’s better to take the high road and be upfront about all your financial matters.

This will be a very emotional time. Even when you know the divorce is for the best, that the love is gone and there’s no point in trying to fix something that’s gotten so broken, you’re still going to find yourself having second thoughts and riding an emotional roller coaster. No matter what else might be happening in your life, you need to make sure you take care of yourself. Find time to do something fun or relaxing. You don’t want your health to suffer, which it will if you don’t come up with a good way to alleviate the constant stress.

You should be prepared for your divorce lawyer to ask you some questions you might not want to answer. The first will be why you’re getting divorced. This will be especially difficult if you know the fault lays on your shoulder. In addition to knowing why you’re getting divorced, the divorce lawyer will also want information about how long the activities triggering the divorce proceeding went on. Since the answers to both questions will have a huge impact on the final outcome of the divorce, and how large a divorce settlement your spouse gets. In this case it’s best to be upfront and honest with the attorney. You should try to remain detached and deliver the answers in a calm, rational, and chronological manner.

Even before you meet with your divorce lawyer for the first time, you should have a good idea about the things you want to bring out of the divorce. You shouldn’t expect to get everything, it’s unlikely that will happen. Instead you should know what items have become very important to your life, which items you don’t care about, and what things you’re willing to compromise on. If a final decision can’t be made, all of the assets will be liquidated and the money will be divided up.
